Is a Velociraptor a HOA Violation? Issuing Homeowner Association Fines to Residents

Hey everybody! I've got a question for you. If I were to take this dinosaur and put it in my front yard would that be a violation in my Association or not?

 

I am Blake Sanford. I am the Director of Association Management here at Property Management Inc., where we make property management manageable. Now about the dinosaur, is that a violation or not? Well it depends, doesn't it? And even if you know it is a violation, do you as a property manager automatically send a violation notice and fine to the resident?

The Property Manager Easy Button for Issuing Fines

There are two groups of people you need to keep in mind when dealing with association violations, board members and homeowners. Don't just send fines even if you know it is a violation with the governing documents. You have been hired as a property management company to come in and work as what I call a “glorified secretary” to the board. If the board says “we need you to send out a fine because they've got a dinosaur in their yard,” then guess what? You are going to send out a fine. If the board says to you “we know about it, it's under control, don't send out a fine” then you are not going to send out a fine. Simply put, your job is to follow the board's direction in all things and that is it.

Always Refer to HOA Governing Documents or CC&R’s

One last thing, homeowners don't always know the rules. They may have lived in the associations for 20-plus years and think they've got it on lock down and know everything that's going on but always refer to the CC&R’s or governing documents to verify that a violation has occurred.
